1. Benwick Sports Angling Centre
1.1 In these Terms & Conditions ‘the company’, ‘Benwick Sports’,’we’,’us’, ‘our’ shall refer to Benwick Sports Angling Centre.
1.2 Our Address is Benwick Sports Angling Centre, Unit 22 Northfield Road Business Centre, Soham, Cambridgeshire, CB7 5UE. VAT No. GB214444589.
1.3 The customer shall be referred to as ‘you’.
2.1 By default Prices displayed on this website are in £ Sterling and include VAT @ 20% unless you are 'logged in' in a country where we ship VAT free in which case VAT is not included. If you use a 'proxy server' or a server which is not UK based then this can cause the website to think you are outside the UK and also show prices with no VAT. If in doubt please contact us before ordering.
2.2 All Zero rated sales are sent 'DDU Delivery Duty Unpaid' This means that the customer is liable to pay any taxes due locally to the shipping agent before taking delivery. The shipping agent will contact the customer to arrange this. If the customer refuses this the goods will be returned to us and the customer charged for delivery.
2.3 Prices and specifications are subject to change.
3.1 When placing an order you will receive an e-mail from us acknowledging receipt of your order. This does not mean that your order has been accepted. Placing an order only constitutes an offer to Benwick Sports to buy a product.
3.2 All orders are subject to acceptance by us and are subject to availability. Any orders which cannot be filled by us will be notified to you by email. Any payment of such order will be cancelled or refunded as soon as possible.
3.3 If we are unable to supply the goods ordered we will sometimes send a replacement but only if the replacement is of equal value or quality. We will try to contact you first to make sure this is acceptable. If we are unable to do this and you are not happy with the replacement goods you have the right to return them and receive a refund of the value of the goods plus your postage cost (up to the value originally paid). Please note that this does not apply to bristle colour on pole floats which can vary from batch to batch and where we quote 'Red' this could be 'Orange' for example. Please see Delivery and Returns section for details.
3.4 If any item ordered is not available 'out of stock' we will try to contact you to to arrange either an alternative or a refund. If we are unable to contact you quickly especially during busy times we reserve the right to refund the individual item and send the balance of the order.
3.5 In the event that we are unable to determine your residential address your order will not be valid. We reserve the right in individual cases to refuse orders.
4. Delivery and Shipping
4.1 Delivery charges are set out in our Delivery and Returns section.
4.2 We will attempt to deliver the goods ordered within the time set out under Delivery and Returns. Delivery times quoted are from time of dispatch by us and not time of order by you. Any items which we cannot supply with the order and are held on ‘Back Order’ with our agreement will be sent at no extra cost to you.
4.3 We will deliver orders using the details that you supply us with. The customer is wholly responsible if goods are shipped to an incorrect address due to giving us the wrong details. Any loss is the customers loss and we cannot be held responsible for incorrect details. We DO NOT have a responsibility to double check all address details given to us before shipping.
4.3 FREIGHT FORWARDING FROM UK - Any goods which we supply to a delivery address in the UK which are being forwarded by a shipping agent to a foreign country must be fully checked for damage or shortages on delivery. Any shortages or damage which occurs after we have delivered the goods to the UK delivery address are no longer the responsibility of Benwick Sports and no claims would be upheld. It is your responsibility to ensure that the goods are checked while still in the UK
4.4 Any goods we supply 'VAT free' may be subject to duty on delivery to the destination country. The customer is responsible for these charges if requested by Customs or the carrier on behalf of Customs on arrival. If the customer refuses to pay these charges then we have the right to charge any costs we incur in returning the goods if necessary.
5. Your right to cancel
5.1 Under the Distance Selling Regulations you have the right to cancel your order within 7 days of delivery. Instructions on how cancel your order will be included in the package. You must notify us of your cancellation by email or post to our address as shown in section 1.2.
5.2 You must return all goods to us in delivered condition, including any free offers etc. with a copy of proof of purchase by insured post or carrier at your own expense. Any goods returned which are not ‘as sold’ may not be refunded as you have a statutory duty to take reasonable care of the goods, this includes returning the goods in the same quality and type of packaging which we dispatched them in.
5.2 Any refunds for cancelled goods will be made by us within 30 days.
6. Faulty goods and shortages
You must notify us by telephone or email within 5 working days of receiving your order if any goods are faulty, damaged or missing. We will then either arrange a collection of the goods or instruct you as to further action. Any costs incurred by you returning goods which were damaged or faulty will be refunded to you. Any goods returned which are found not to be faulty will not have any postage refunded and may incur a charge on you for any costs we have paid as a result of collecting the goods.

All goods which are supplied by us and sent outside the UK are not covered by the manufacturers usual warranty. For example if you buy a rod or pole and a section breaks within the UK warranty period we cannot claim against our supplier as their warranty is only valid inside the UK. We would always suggest that you insure expensive items against damage during use in case of breakages.
